Things have gone from bad to worse as troubled Fisker lays off 75 percent of its employees last Friday. Roughly 210 employees were sent packing without warning or without a paycheck for the next 60 days, as called for by federal law.

The WARN act forbids a company from laying off a large number of employees without a 60-day notification or 60 days worth of pay. The penalty for breaking the WARN act has Fisker slapped with a federal lawsuit.

Automotive News was told by several former employees outside the Fisker headquarters that no severance pay or notice was given; only compensation for unused vacation days.

Fisker might have one small hope in avoiding a huge federal lawsuit by citing the two exceptions in the WARN act: a faltering company or unforeseeable business circumstances.

Fisker is left with roughly 53 senior managers and executives as they presumably look for buyers for the company assets.
