Back in June 2011, a lawsuit against Chevrolet and General Motors was filed for faulty suspension components on 2007 and 2008 Impala sedans. Blakely, Pa. resident, Donna Trusky complained that her rear tires prematurely wore at just 6,000 miles due to bad rear spindle rods. Trusky demands that Chevrolet repair the issue, but GM has a different opinion.

According to an article by Automotive News, the General admits that the Impalas were poorly made but done so under the old, pre-bankruptcy GM. Because of this, the “New GM” is not wanting to accept responsiblity for the Impala’s issue. They say that the model year Impala was built under a separate company and that the post 2009 bail-out General Motors no longer associates with the older company. In short, Chevrolet is saying that Trusky is going after the wrong GM.

“New GM’s warranty obligations for vehicles sold by Old GM are limited to the express terms and conditions in the Old GM written warranties on a going-forward basis,” wrote Benjamin Jeffers, a lawyer for GM. “New GM did not assume responsibility for Old GM’s design choices, conduct, or alleged breaches of liability under the warranty.”

General Motors isn’t necessarily ignoring the Impala lawsuit. They have agreed to make repairs only under the conditions of the written warranty.
